Terms of Service
1. About these Terms
These Terms govern your use of Push Crate (the "Service"), operated by Team Push Crate, a small independent team based in the Republic of Korea ("we", "us"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
2. Definitions
- Service — the online board game at pushcrate.net and related features.
- User — anyone who accesses the Service.
- Member — a User with an account who has signed in.
- Guest — a User who plays without an account.
- Content — all software, design, text, images and game rules in the Service.
3. Eligibility
- You must be at least 13 years old to use the Service.
- If the law where you live sets a higher minimum age, that age applies. In the European Economic Area this may be anywhere from 13 to 16 depending on the country; below your country's threshold you need consent from a parent or guardian.
- Residents of the Republic of Korea under 14 require the consent of a legal guardian.
- If we learn a User does not meet the age requirement, we may delete the account.
4. The Service
- Push Crate is a two-player strategy board game played in a web browser.
- You can play Casual matches without creating an account.
- Ranked matches require a signed-in account.
- The Service is currently free of charge. Paid features, if introduced, will be announced in advance.
5. Accounts
- Accounts are created by signing in with a Google account. We do not issue or store a password for the Service.
- Access to your account depends on your Google account. If you lose access to it, or delete it, we cannot restore your Push Crate account.
- You are responsible for keeping your Google account secure. We are not liable for loss arising from a shared or poorly protected Google account.
- You may not transfer, lend or sell your account.
- You can delete your account at any time from your profile screen.
6. Acceptable Use
You agree not to:
- Modify the game client, or use bots, macros or automation to affect results or rankings;
- Exploit vulnerabilities or attempt unauthorised access to our servers;
- Use another person's account, or impersonate anyone;
- Use abusive, discriminatory or obscene language, or another person's personal information, in your nickname or elsewhere;
- Place unreasonable load on the Service through automated access;
- Reverse engineer, copy, distribute or sell the Service;
- Harass other players or deliberately disrupt their games;
- Break any applicable law.
7. Suspension and Termination
- If you breach Section 6 we may — without prior notice — warn you, restrict Ranked play, suspend your account, or delete it permanently.
- Serious or repeated breaches may result in immediate permanent action.
- You may appeal to pushcrate.game@gmail.com. We will review and respond within a reasonable time.
- Every administrative action is logged with the administrator, timestamp and reason. These logs cannot be altered or deleted.
- Provisions that by their nature should survive termination (intellectual property, limitation of liability, governing law) continue to apply.
8. Game Records and Rankings
- Match results and statistics are stored to operate the Service and calculate rankings.
- We do not alter win/loss records.
- Where a system error or outage has unfairly changed a rating, we may correct it. A reason is always recorded when we do.
- If you delete your account your link to past matches is removed, but the records themselves are kept in anonymised form to protect your opponents' history.
- Replays are kept for your five most recent matches only, then deleted automatically.
9. Intellectual Property
- All source code, game rules, design, graphics, text and logos are owned by the Operator and protected by intellectual property law.
- You may not copy, distribute, publish, adapt or commercially exploit the Content without our prior written permission.
- You receive a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes.
- You keep the rights to content you enter (such as your nickname), and grant us permission to display it as needed to run the Service.
- We may edit or remove content you enter if it breaches Section 6.
10. Changes to the Service
- We may change, suspend or discontinue any part of the Service.
- Planned maintenance is announced in advance. Urgent fixes or security measures may be announced afterwards.
- If we shut down permanently we will give at least 30 days' notice and try to give you time to retrieve your data.
11. Disclaimers and Limitation of Liability
- We are not responsible for:
- Events beyond our control — natural disasters, war, power or network failure;
- Problems caused by your own device, connection, or failure to protect your Google account;
- Unlawful acts by third parties such as hacking or denial-of-service attacks, except where we failed to take reasonable protective measures;
- Disputes between Users, or between a User and a third party;
- Any benefit you expected from the Service but did not receive.
- We take reasonable steps to back up data, but cannot guarantee data will never be lost.
- The Service is provided "as is", with no express or implied warranty that it will be uninterrupted, error-free, or fit for any particular purpose.
- Because the Service is free, our liability is limited to the maximum extent permitted by law. Except for wilful misconduct or gross negligence, we are not liable for indirect, special, consequential or incidental damages, or lost profits.
- Nothing here limits rights you have under mandatory consumer protection law. If the law where you live gives you stronger protection, that law prevails.
12. Governing Law and Jurisdiction
- These Terms are governed by the laws of the Republic of Korea.
- Disputes will be brought before the Seoul Central District Court as the court of first instance.
- If you are a consumer, this does not remove your right to bring proceedings in the courts of your country of residence where local consumer protection law gives you that right. Consumers resident in the EEA may bring proceedings in their local courts.
13. Changes to these Terms
- We may amend these Terms. Changes and their effective date will be published in the Service at least 7 days beforehand — or at least 30 days where the change is significant or disadvantageous to you.
- Where you have registered an email address, we may also notify you by email.
- If you do not accept the changes you may delete your account before the effective date. Continuing to use the Service after that date means you accept the amended Terms.
14. Governing Language
- These Terms and the Privacy Policy are written in English, and the English version is the authoritative text.
- Translations into other languages are provided for convenience only.
- If there is any discrepancy, ambiguity or conflict between the English version and a translation, the English version prevails and governs the interpretation of these documents.
- This does not limit any right you have under mandatory law in your country of residence to receive information in your own language.
